Terms of use

Totem makes small multiplayer places on the web. PaintRoom is a game where players paint together through a succession of rooms. Slop Theater is a cinema where you walk in, take a seat, and watch a live stream on the big screen with everyone else in the room. These terms cover both; where a game has its own rules, they are said below.
Who can play
You must be at least 13 to use our games. If you are under 18, only make a purchase with permission from a parent or guardian.
Playing without an account
We ask for nothing but a name. In place of an account, your browser holds a random identifier that the game uses to recognise you between visits. Your name, your character, your painting reserve in PaintRoom, and anything you have paid for hang on that identifier and on nothing else.
If you clear your browser data, play in a private window, or move to another browser or device, the identifier may be lost along with everything attached to it, including your purchases. We cannot automatically recognise you again. Keep the receipt Stripe emails you: send it to hello@kevin-tale.com and we can usually restore your access.
Names
You choose the name shown to other players. Names that impersonate the house, its makers, or people connected to what is shown on screen are refused, and we may reset any name we consider abusive.
What is for sale
Everything not marked as paid is free. Some things are paid, and each is described and priced at the moment you buy it:
- In PaintRoom: access to canvases — the free-paint surfaces in a room — and the right to paint your own Cubvatar. Its own purchases page sets out the detail of what a canvas is and how a space on it works.
- In Slop Theater: characters — the look other people in the room see you as. A paid character is bought once and stays on your identifier for as long as we run the game.
Prices are shown in US dollars, because our rooms are played from everywhere. The amount actually charged, including any tax owed in your country, is displayed at checkout before you confirm. Prices can change; the one that applies is the one shown when you pay.
Payment and delivery
Stripe handles payments. Your card details go to Stripe and never reach us — we receive the email address you enter, the country used to work out tax, and whether the payment went through. Access is granted immediately after a successful payment, to the identifier held by the browser you paid from. There is nothing to download and nothing to install.
Keep the receipt Stripe sends you. Since we hold no account for you, that receipt is the only proof of purchase there is, and the only way we can restore access if your browser loses its identifier.
Your right to change your mind
As a consumer in the European Union you normally have fourteen days to withdraw from an online purchase. Digital content delivered at once is the exception: by asking for immediate access you expressly ask us to begin performing straight away and accept that the right of withdrawal is lost once access is granted. The checkout asks you to tick a box agreeing to these terms, which say the same, before it takes any money.
When we refund
- if access was never granted, or does not work, and we cannot fix it — in full;
- if you were charged twice — the duplicate;
- purchases are not normally refunded following a ban for breach of these terms.
Ask at hello@kevin-tale.com; refunds return to the card that paid. Please write to us before opening a dispute with your bank: a chargeback costs us a fee and takes longer for you. Invoices on request at the same address.
The screen in Slop Theater
What plays on the screen is Infinite Slop, a live channel made by a third party, shown with their agreement. We do not make it, choose it or moderate it, and we make no promise about what it shows or that it stays on. You cannot interact with it from the room; the room is for watching together.
What you may not do
- anything unlawful under French law;
- in PaintRoom, paint sexual content involving minors, in any form or style — this is reported, not merely banned;
- threats, harassment, or incitement to hatred or violence against a person or a group, in a name or in paint;
- someone else's private information: names, addresses, telephone numbers, faces;
- work you hold no right to reproduce;
- disrupt a room: flood it, fake its traffic, or attack the servers that run it.
In PaintRoom, painting over what someone else made is not on that list. The room is collective and impermanent on purpose.
Moderation
We may remove paint, reset a name or a character, and refuse a player entry, at our discretion and without warning, when the rules above are broken. A ban applies to the identifier held by that browser. To report something, write to hello@kevin-tale.com with roughly when you saw it and where.
What you paint, and who may use it (PaintRoom)
You keep whatever rights you hold in what you paint. By painting in a shared room you allow us to store it, show it to other players, keep it in that room's archive, include it in timelapses and screenshots, and use those images to present PaintRoom publicly. That permission costs nothing, applies worldwide, and lasts as long as we run the game or keep the archive. A single stroke usually cannot be lifted back out of a work made by everyone; what we can do, if you ask, is detach your name from it.
Nothing here is permanent
Rounds end and rooms close. Archives may be altered or taken down; a stream may stop. We make no promise that anything will exist tomorrow, and the games are offered as they are, with no undertaking that they are available or free of faults.
Our liability
Nothing here removes the rights you hold as a consumer under French law, nor our liability for personal injury, fraud, or anything else that cannot lawfully be limited. Beyond that we are not liable for indirect loss, for time spent, for paint lost, or for the consequences of the service being interrupted.
Changes
These terms can change. The date above says when they last did, and a change that materially affects you will be announced in the game. Playing on after a change means you accept it.
Law and disputes
French law governs these terms. If you are a consumer living in the European Union you may also rely on the mandatory protections of your own country and go before its courts. Before starting formal proceedings, you can contact us at hello@kevin-tale.com so we can try to resolve the issue.
